Terms of Use
Effective November 7, 2026
These Terms of Use ("Terms") are an agreement between you and Kismet Cup ("Kismet Cup," "we," "us") for the Kismet Cup iPhone app and this website. By creating an account or using the app, you agree to these Terms and to our Privacy Policy.
Kismet Cup is operated by Ali Murat Erkek, an individual developer based in İzmir, Türkiye.
For entertainment purposes only. Coffee cup readings, tarot, horoscopes, and birth charts in Kismet Cup are written for fun and reflection. They do not predict the future and are not medical, legal, financial, or psychological advice. Please do not make important decisions based on a reading.
1. Entertainment only
Kismet Cup offers readings as a playful daily ritual. Readings use open language such as "may" and "could" on purpose, and they never address death, serious illness, pregnancy, or legal and financial direction. A reading is not a statement of fact about you or your future, and we make no promise that anything it describes will happen.
If you are going through something hard, please talk to someone you trust or a qualified professional. In an emergency in the United States, call 911. You can call or text 988 to reach the 988 Suicide & Crisis Lifeline at any time.
2. Who can use Kismet Cup
You must be at least 13 years old to use Kismet Cup. If you are under 18, you may use it only with the permission of a parent or legal guardian, who agrees to these Terms for you. Kismet Cup is offered for use in the United States.
3. Your account
You need an account to use Kismet Cup, created with Sign in with Apple or with an email address and password. Please give accurate information, keep your password private, and let us know at [email protected] if you think someone else has used your account. You are responsible for activity on your account. Each person may have one free reading; creating extra accounts to get more free readings is not allowed.
4. Free plan, Premium, and automatic renewal
Free plan. Your first coffee cup or tarot reading is free. Your daily horoscope, your reading history, and favorites are free for everyone.
Premium. Kismet Cup Premium is an auto-renewing subscription that currently includes unlimited coffee cup and tarot readings and your birth chart (Sun, Moon, and Rising). It is offered monthly (currently $9.99 per month) or yearly (currently $59.99 per year), in U.S. dollars. The price and length shown in the app at the time of purchase are the ones that apply.
Free trial. Eligible new subscribers may get a free trial (currently one week). Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription and your Apple ID is charged. Trial eligibility is decided by Apple and is limited to one per Apple ID per subscription group. If you buy a subscription during a free trial, any unused part of the trial ends.
Billing and renewal.
- Payment is charged to your Apple ID account when you confirm the purchase, or when a free trial ends.
- Your subscription renews automatically for the same period and price unless automatic renewal is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in Settings > [your name] > Subscriptions on your iPhone. Canceling stops future renewals; you keep Premium until the end of the period you paid for.
- Deleting the app or your Kismet Cup account does not cancel your subscription.
- If a price changes, Apple will notify you in advance as its rules require, and you can cancel before the new price applies.
Refunds. All purchases are processed by Apple, and Apple handles refund requests under its policies at reportaproblem.apple.com. We cannot issue refunds directly.
Restoring purchases. If you reinstall the app or use a new iPhone with the same Apple ID, tap "Restore purchases" on the Premium screen.
5. Your photos and readings
You keep ownership of the photos and information you give us. You give us permission to use them only to run Kismet Cup for you: to write your readings, show them to you, and keep your account working, as described in our Privacy Policy. Cup photos are deleted as soon as your reading is ready.
Please upload only photos of coffee cups that you have the right to share, and do not include other people, personal documents, or anything unlawful. You may save and share your own readings for personal, non-commercial use; shared readings may carry a small Kismet Cup mark.
6. AI-written content
Readings are generated by an artificial intelligence model. Each one is new, so two readings of similar cups may differ, and a reading can occasionally be inaccurate, repetitive, or feel off. We screen readings to keep them warm and to avoid sensitive topics, but we cannot review every reading before you see it. If a reading seems inappropriate, please tell us at [email protected].
7. Fair use
When using Kismet Cup, please do not:
- copy, resell, or publish readings at scale, or use them to build a competing service or train AI models;
- use bots, scripts, or other automated means to access the app or our servers;
- try to get around free-reading limits, security checks, or payment;
- reverse engineer, interfere with, or overload the app or its servers, except where the law allows it;
- upload content that is unlawful, harmful, or infringes someone else's rights; or
- use Kismet Cup for any unlawful purpose.
8. Our content
The Kismet Cup name, logo, design, artwork, and software belong to us or our licensors and are protected by law. Subject to these Terms and Apple's standard EULA, you may use the app for your own personal, non-commercial use.
9. Ending your use
You can stop using Kismet Cup at any time and delete your account in the app (Profile > Delete account). Remember to cancel any subscription separately in your iPhone settings. We may suspend or close an account that seriously or repeatedly breaks these Terms, or if required by law, and we will tell you when we reasonably can. We may change or discontinue features of the app; if we discontinue the service as a whole, we will give notice in the app in advance.
10. Apple's standard EULA
The Kismet Cup app is licensed to you, not sold, under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms supplement the Standard EULA. If the two conflict on the license to use the app, the Standard EULA controls.
You and we also acknowledge that:
- these Terms are between you and Kismet Cup only, not Apple, and Kismet Cup, not Apple, is solely responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the app;
- Kismet Cup, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims;
- Kismet Cup, not Apple, is responsible for investigating and handling any claim that the app infringes someone's intellectual property rights;
- you represent that you are not located in a country subject to a U.S. government embargo or listed on a U.S. government list of prohibited or restricted parties; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Disclaimers and limits of liability
Kismet Cup is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that the app will be uninterrupted or error-free or that any reading will be accurate.
To the fullest extent permitted by law, Kismet Cup will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any decision you make based on a reading. Our total liability for any claim relating to Kismet Cup is limited to the greater of the amount you paid for Premium in the 12 months before the claim or $50. Some states do not allow certain of these limits, so they may not apply to you, and nothing in these Terms limits rights you have under law that cannot be waived.
If you have a concern, please email us first at [email protected]; most issues can be resolved quickly that way.
12. Changes and contact
We may update these Terms from time to time. We will change the effective date above, and for significant changes we will let you know in the app before they take effect. If you keep using Kismet Cup after a change takes effect, you accept the updated Terms.
